BASI requirement for Criminal Record Disclosures

The BASI Board would like to thank you for helping BASI follow “Best Practice” and ensure that all our members issued with licences in the future have been checked by Disclosure Scotland.

To issue a BASI licence BASI will require each member to provide an Enhanced Criminal Record disclosure (The Disclosure Service chosen by BASI for this is Disclosure Scotland). This will be implemented from the 1st October 2008. (BASI have been notifying members through the BASI News for over a year regarding the implementation of this process).

Important Note: If you have been a resident for 5yrs or more in a foreign country, you will have to go through the disclosure process in the country to which you reside.  If residency is less than 5yrs, then you are required by BASI to go through the Disclosure Scotland process.

Your disclosure application form must be Counter signed by a BASI Counter Signatory.  The Counter Signatory must sight 3 original documents which provide verification of your identity, at least one must be photo id, see details in application form.

Do not send photocopies of documents to a Counter Signatory as the form will be returned to you.
BASI will require a Disclosure once every 3 years.

BASI cannot accept disclosures that have been done for other employers or agencies.  Currently Disclosure's are not portable.

The process for members to complete an Enhanced Criminal Record Disclosure is below.
In order to receive an Instructor licence BASI members are required provide an Enhanced Criminal Record Disclosure.

Process

  1. Contact Disclosure Scotland and request an application form for an enhanced Criminal Record Disclosure. (Downloadable form on the website is not usable for Enhanced Disclosure).

  2. Complete the form including the payment details and ensure that you tick the box for enhanced disclosure.
  3. Ask a BASI Trainer (who is a counter signatory) to countersign the application (this service can be done in the BASI office for you, this requires you to send your completed form ready for countersigning along with your original ID documents which will be sent back to you directly by secure post).You will find a list of counter signatories at the bottom of this page.
  4. Note the Counter Signatory is required to confirm your identity therefore you should provide evidence of your identity as described in the application form.
  5. Send your application to Disclosure Scotland with payment.
  6. Disclosure Scotland will send you a copy of the disclosure and one to the Disclosure Officer at the BASI office.
  7. The BASI Office will update your records and your licence will be posted to you.

Please note all Disclosure information will be treated with the utmost confidentiality and any disclosures will be destroyed as soon as they have been processed or when any enquiries are completed.

What if my disclosure shows items on my record?

Should a Disclosure show that an individual has a criminal record this does not automatically mean that, that person will not receive a BASI licence (some items on a disclosure will not be regarded as a risk in this area). The BASI Child Protection panel will be informed and could contact that person. The Panel would make a risk assessment on whether that individual was a risk to children. All aspects of this process would be done with the strictest confidentiality.

Are Disclosures Portable?

Currently Disclosures are not Portable.  BASI require you to complete a new Disclosure for renewal of your Licence, this Disclosure process is required for BASI every 3 years.  Without completion of the Disclosure you will not be covered by BASI to Instruct with your qualification.

Do I need to do another Disclosure for my employer (Snowsport School)?

BASI is an Umbrella Body therefore any Snowsport Schools who have joined the BASI Affiliate Membership Scheme (specific criteria must be adhered to to become an Affiliate Scheme Member) can accept the BASI licence as proof of having done a Disclosure with Disclosure Scotland (your employer may however ask you to do a new disclosure).

If a Snowsport School is not an affiliate member the BASI disclosure will not be relevant for that Snowsport School.

What if I don't need a license but still want to be a member?

Yes you can!  For those who either do not teach any more or would just like to be a member of BASI you can be a member without a license.  You will receive a membership card rather than a license, regular BASI News, BASI Directory, Members Offers.  Basically all the benefits without the license and the insurance for professional indemnity.  (Please note your membership card will not show your qualification/s or if applicable ISIA number).
